THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5893 of 2015 ORDER:

The writ petition is filed alleging that the officials of the 2nd respondent are threatening to demolish the residential tenement of the petitioner in Plot No.62/A, admeasuring 120 Sq.yards in Survey Nos.89/A and 89/C of Nizampet village, Quthbullapur mandal, Ranga Reddy district.

2. The averments in the writ affidavit are to the effect that the petitioner claims to have acquired the land in question from her husband through registered gift deed dated 08.04.2013, and after obtaining necessary permission from the competent authority, she constructed a residential house. While so, the officials of the 2nd respondent have come to her house and threatened to demolish the house. She submitted a representation on 12.02.2015.

Learned Assistant Government Pleader, on written instructions from the Deputy Collector & Tahsildar, Quthubullapur mandal, submits that the lands in Survey Nos.89/A, 89/B, 89/C and 89/D situated at Nizampet village, Quthbullapur mandal, Ranga Reddy district, are recorded as patta lands and the total extent of land in the said Survey Number is Ac.9-15 guntas, and the respondents are not concerned with those lands. It is also stated that the respondent authorities have not interfered in any manner with the possession of the petitioner at any point of time and the allegations of the petitioner are not true.

In the light of categorical statements of the respondent authorities that they are not interfering with the possession of the petitioner at any point of time, the same is put on record and the writ petition is closed as no orders are required in this writ petition. However, it is open to the petitioner to avail appropriate remedy available to her under law, in case she apprehends a real threat to her peaceful possession over the

land in question. No costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
