THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.31294 of 2014 ORDER:

Heard learned counsel for the petitioner as well as learned Government Pleader appearing for the respondents 1 to 3. 2.

The prayer sought in the writ petition is as under:- "...to issue a Writ/Order/s more particularly one in the nature of Writ of Mandamus, declaring the inaction of the respondent no.3 pursuant to the petitioner's complaint dated 15/08/2014, received on 20/08/2014, as being illegal, arbitrary and violative of Article 21 and contrary to Section 154 of CrPC and consequently direct the respondent no.3 to register FIR and investigate the matter and be pleased to pass such other order/s as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned Government Pleader placed on record the written instructions issued by the Inspector of Police, Cyber Crime Police Station, Cyberabad.

From a perusal of the said written instructions, it is revealed that on 20.08.2014, the Inspector of Police received a complaint from the petitioner. On receipt of the said complaint, the Inspector of Police conducted an enquiry into the matter. During the course of investigation, the then Investigating Officer collected the details of amount, where it was transferred, and also collected the call details from the concerned. On verification of account holder's address, it is learnt that the said address is found to be false. In fact, the Inspector of Police tried to trace out the fraudster, who is operating from Delhi, however, the said phone was switched off. In this case, the fraudsters could not be identified and traced, in spite of making sincere efforts.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.
