THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.42322 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Land Acquisition.

The petitioner claims that the respondents are likely to dispossess him and demolish his house to an extent of 107 sq. yards in Plot No.884-A of Vadlapudi R.H. Colony, Sector-II, Visakhapatnam. It is, however, accepted in the affidavit that the petitioner had given a show cause notice in Rc.No.18/2013/R1, dated 03.10.2015, by the Special Grade Deputy Collector (L.A.), Steel Plant, Visakhapatnam, the 2nd respondent, for which he has already given a detailed explanation, dated 03.11.2015. The petitioner alleges that as no orders are passed and no enquiry is held so far, there is an attempt to dispossess him and demolish his house.

Learned Government Pleader for Land Acquisition, who has received instructions from the 2nd respondent, submits that the petitioner was given notice and his explanation, dated 03.11.2015, was received by Speed Post and the file is under process. However, the instructions deny that the petitioner is neither displaced person nor married major son is displaced as on the cut-off date and the eligibility of the petitioner is yet to be adjudicated and decided. In view of the same, the Writ Petition is disposed of directing the 2nd respondent to consider the explanation, dated 03.11.2015, submitted by the petitioner, with reference to the show cause notice

issued to him, and take appropriate decision in the matter in accordance with law. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
