HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10734 OF 2017 ORDER:

The case of the petitioner is that his grandfather was the absolute owner and Inamdar of the land admesuring Ac.25.07 guntas in Sy.No.136 of Anmagal Village, Hayathnagar Mandal, Ranga Reddy District and thereafter, petitioner's father and his 4 brothers succeeded to the said property. But the then Tahsidlar mutated the names of the petitioner's parents in the revenue records in respect of the land to an extent of Ac.4.24 gts instead of 25.07 gts and brought into existence some false survey numbers i.e., Sy Nos.381 and 382. Basing on the said fake survey numbers, third parties have fabricated the pahanies and are proceeding to register the documents mentioning the false survey numbers in respect of the subject land. With regard to the same, the petitioner made a representation on 29.08.2016 and requested the authorities not to receive or register the documents in respect of the land in Sy.Nos.136, 381 and 382. As no action has been taken, the present writ petition is filed.

Heard both sides.

It is to be seen that petitioner is seeking a direction to the respondents 2 and 3 not to receive the documents in respect of the land in Sy.Nos.136, 381 and 382. This Court cannot decide title of the petitioner by going into disputed questions of fact and give direction as prayed for by the petitioner. It is for the petitioner to approach the Civil Court for redressal of his grievance in the writ petition.

In view of the same, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
