THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI CRIMINAL PETITION No.2563 of 2019 ORDER:

This Criminal Petition is filed seeking to recall the Non Bailable Warrants (NBWs) issued against the petitioner, who is accused No.2 in C.C.No.61 of 2016 on the file of the learned Judicial Magistrate of First Class (Special Mobile), Karimnagar. Learned counsel for the petitioner submits that the petitioner will appear before the Court below and let the Court below consider his case and recall the NBWs issued against him. He further submits that on 24.12.2018, as there was some communication gap between the petitioner and his Counsel, the Counsel appearing for the petitioner has reported that he has no instructions, and the Court below has ordered issuance of NBW against the petitioner.

Learned Public Prosecutor submits that, let the petitioner appear before the Court below and on the same day the petitioner's case be considered by the Court below and appropriate orders be passed on the same day. In view of the rival submissions made by the parties, the petitioner is directed to appear before the Court below within a period of one week from the date of receipt of a copy of this order, and upon such appearance of the petitioner, let the Court below consider and pass appropriate orders and recall the NBW

issued against the petitioner after being satisfied about the case.

With the above observations and directions, this Criminal Petition is disposed of. The miscellaneous petitions pending in this case, if any, shall stand closed. There shall be no order as to costs.
