THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY AND THE HON'BLE SRI JUSTICE K.LAKSHMAN W.P.NOS.10527 AND 10546 OF 2020 COMMON ORDER (per the Hon'ble Sri Justice A.Rajasheker Reddy) Aggrieved by the final assessment orders in ASMT:CST/ 36897552617/ 15-16 dated 27.03.2020 and ASMT:Ao.No.33806/ CST/ 36133379476/ 15-16 dated 21-03-2020 respectively, passed by the 1st respondent in both the writ petitions, the present writ petitions have been filed. Sri S.Krishna Murthy, learned counsel appearing for the petitioners in both the writ petitions would submit that the impugned orders have been passed in gross violation of principles of natural justice and that the lis in the writ petitions is squarely covered by the common order passed by this Division Bench of this court in W.P.Nos.7410, 7413, 7423 and 7436 of 2020 dated 10.06.2020. He submits that the present writ petitions may also be allowed in terms of the said common order.
Sri J.Sunil Kumar, learned Standing Counsel for Commercial Taxes, does not dispute the above submission of the learned counsel for the petitioners.
In view of the above submissions of the learned counsel, and for the reasons alike recorded in the above referred order of the Division Bench of this court, the impugned assessment orders are aside, and the matters are remanded to the respective1st respondent in both the writ petitions, to pass assessment orders afresh, after affording reasonable opportunity to the petitioners to submit all the documents and also after affording a personal hearing to the petitioners to put forth its objections.
This exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
Accordingly the writ petitions are allowed to the extent indicted above.
Interlocutory applications pending, if any, shall stand closed. No order as to costs.
