HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 609 of 2017 Order:

This Writ Petition was filed challenging the action of the respondents in not conducting any investigation into the crime registered against the respondents 4 to 25 even after registering the case in Crime No.8 of 2014 by the third respondent way back on 31.01.2014. Now a counter affidavit is filed stating that the investigation was completed by the then Investigating Officer and the SDPO, Ongole after completion of the investigation sought prior permission of the Inspector General of Police, South Coastal Zone, Guntur Range, Guntur to refer the case as 'false'. The Inspector General of Police, South Coastal Zone, Guntur, vide his letter dated 09.12.2016, accorded permission to refer the case as 'false'. Though efforts were made to serve the notice to the complainant in his native place at Boddulurivaipalem village, the complainant refused to take the notice. It is stated that the final report will be submitted to the Judicial Magistrate of First Class, Special Excise Court, Ongole on 18.01.2017.

In view of the same, no further orders are necessary in the present Writ petition and the Writ Petition is, accordingly, closed. However, liberty is given to the petitioner to take appropriate legal proceedings in accordance with law. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
