Manimala Madhusudhan Reddy, Spsr Nellore Dist., And 4 Otrs. v. The Acb.,Rep.By Director, Hyderabad, And 2 Otrs.
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.4804 of 2012 ORDER:
The relief sought for in this writ petition is for a mandamus to declare the action of the respondents in interfering with the business conducted by the petitioners as per A-4 licence issued by the Prohibition and Excise Superintendent, Nellore under the guise of investigation in Crime No.2/RCO/NLR.2012, as illegal and arbitrary. The period of excise licence is said to be 2 years and, since the petitioners have stated in the writ affidavit that they were granted licence for the years 2010-2012, it is evident that the licence period itself expired six years ago. The cause in the writ petition, therefore, does not survive necessitating any further adjudication by this Court and the writ petition has become infructuous.
The Writ Petition is, accordingly, dismissed as infructous. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
