THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22024 of 2016 ORDER:

The case of the petitioners is that they have been paid old age / widow / handicapped pension for some period and thereafter, they are not being paid the same, in contrast to the guidelines issued in G.O.Ms.No.135, dated 17.09.2014.

Heard learned counsel for the petitioners.

Sri Ravi Cheemalapati, learned Standing Counsel for Respondents 3 and 4 would submit that G.O.Ms. No. 135, dated 17.09.2014 prescribes procedure for verification of eligibility of pensioners and collection of applications for granting new pension. He would further submit that in the process of verification, the petitioners have been found as ineligible, therefore, they have not been sanctioning pension. However, the learned Standing Counsel admits that no communication in that regard has been made to any of the petitioners detailing the circumstances under which they are not being paid the pension. According to the learned Standing Counsel, an Appeal has been provided to the Committee consisting of MPDO against the denial of pension in terms of G.O.Ms.No. 135, dated 17.09.2014.

In view of the submissions made by the learned Standing Counsel, interests of justice would be better served if a direction is given to the 4th respondent to communicate the reasons, in writing, to the petitioners, within fifteen days from the date of receipt of a copy of this order, for not sanctioning the pension, which has been paid for some time. On receipt of such communication, the petitioners may file an Appeal before the Appellate Authority-MPDO Committee, which, in turn, within a

period of six weeks thereafter, shall consider the same and pass appropriate orders restoring pension to the petitioners, if they are otherwise found eligible.

With this, the Writ Petition stands disposed of. No costs. Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
