HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.5148 of 2017 ORDER:
Heard learned counsel for the petitioner, who is the election petitioner in O.P.No.5 of 2013 pending on the file of Election Tribunal-cum-Junior Civil Judge, Huzurnagar. She is the defeated candidate in the election. Respondent No.5 is duly elected among 3 contested candidates including the other defeated candidate respondent No.6. The matter is coming for disposal by recording evidence.
In fact, it is the duty of the Tribunal to formulate the points for consideration or to frame issues by hearing. It is unknown what the matter was given several dates for issues, leave about the so called draft issues submitted by the election petitioner on 13.07.2017, '2' in number which are even incomplete as another issue required to be framed if not to properly amend the draft issue No.1 of consequential prayer sought for to incorporate. Thus, the trial Court is directed to formulate the issues within one week from the date of receipt of this order by hearing the parties if present or on own merits from the petition and counter respectively and conduct trial of the matter for early disposal at any cost within four (04) months from the date of receipt of this order.
Accordingly and in the result, the Civil Revision Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed.
