HON'BLE SRI JUSTI CE SANJAY KUMAR AND HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON No.7833 of 2018 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) The prayer of the petitioner in this case reads as under: "For the reason stated in the accompanying affidavit it is prayed that, this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the notice dated 28-02-2018 which was affixed by the respondent on the wall of petitioner factory/ company after entering into the OTS vide Ref.No.
3000/REC/RV/2017 dated 29-09-2017 in between the petitioner and respondent in pursuance of Crl.Petition filed under SARFAESI Act, is being illegal, arbitrary and violative of Article 19, 21 of Constitution of India and consequently to set-aside notice dated 28-02-2018 and pass such other order or orders as this Hon'ble Court may deem think fit and proper." Sri Gopala Krishna, learned counsel representing Sri A.Krishnam Raju, learned counsel for the Syndicate Bank, the respondent herein, would inform this Court that the loan account in relation to which this writ petition was filed has since been closed.
In that view of the matter, the cause in this writ petition no longer survives for adjudication on merits.
