THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13042 OF 2016 ORDER:

This petition is filed by the petitioners-A2 and A3 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.85 of 2013 on the file of the Additional Judicial Magistrate of First Class, Kavali, SPSR Nellore District.

Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. The 2nd respondent is the wife of A1. The petitioners are the parents of A1.

Learned Counsel for the petitioners submitted that there are no specific allegations against the petitioners and that the petitioners are falsely implicated in the above crime.

Learned Additional Public Prosecutor opposed this petition. The truth or otherwise of the allegations cannot be decided by this Court. Therefore, this Court is not inclined to grant the relief sought by the petitioners.

At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of the petitioners before the trial Court is dispensed with except on the dates when their presence is specifically required by the trial Court. The petitioners are directed to be represented through a Counsel before the trial Court on all hearing dates.
