THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL REVISION CASE NO.686 OF 2018 ORDER:

This revision is filed under Sections 397 and 401 Cr.P.C aggrieved by the order, dated 05.02.2018, in M.C.No.29 of2014, on the file of the Judge, Family Court, Khammam, wherein the respondents 2 and 3 herein each were granted maintenance of Rs.5,000/- per month.

Heard learned counsel for the petitioner and perused the record.

Learned counsel for the petitioner would submit that maintenance granted is highly excessive. The 1st respondent is working as Junior Lecturer and getting substantial money towards salary and ultimately, prayed to set aside the impugned order. 4.

As per the record, the petitioner is working as School Assistant. He has capacity to maintain his children i.e., respondents 2 and 3. The Court below was pleased to grant maintenance of Rs.5,000/- per month to each of the respondents 2 and 3, which is reasonable. There is no mis-carriage of justice. There is nothing to interfere with the impugned order. 5.

Accordingly, the Criminal Revision Case is dismissed. Miscellaneous petitions, if any pending in this revision shall stand closed.
