THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.13979 of 2011 ORDER:

The proceedings under challenge in this writ petition is the order passed by the Deputy Commissioner of Endowments dated 26.03.2011 appointing the 5th respondent as a single trustee of the subject temple. Section 17(2) of the Andhra Pradesh Charitable and Hindu Religious Institutions & Endowments Act, 1987 stipulates that every trustee, appointed under Section 15, shall hold office for a term of two years from the date of taking oath of office and secrecy. As the impugned proceedings is dated 26.03.2011, the two year period would have expired by 26.03.2013 or soon thereafter. It is, therefore, evident that the cause in the writ petition no longer survives. Sri T.C.Krishnan, learned counsel for the petitioner, would, however, request that the respondents be directed to constitute a Board of trustees for the subject temple.

We have no reason to doubt that, on a representation being made by the petitioner in this regard, the said representation shall be given its due consideration by the authorities concerned. The Writ Petition is, accordingly, disposed of. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
