ORDER:

This writ petition is filed for a mandamus to declare the action of the respondents in trying to dispossess the petitioners from their respective agriculture lands situated in survey No.490 of Mogalthur Village and Mandal, West Godavari District, without any manner of right or title over the said property, under the guise of the orders, dated 30.03.2010, in O.A.Nos.180, 197 and 211 of 2008, passed by respondent No.5, even though civil suits - O.S.Nos.224, 225 and 226 of 2011 are pending on the file of learned Senior Civil Judge, Narasapur, West Godavari District, without following the provisions of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 and the Rules made therein, as illegal and arbitrary.

After arguing the case, Mr.Dasari S.V.V.S.V.Prasad, learned counsel for the petitioners, has requested for permission of the Court to withdraw the writ petition, with liberty to his clients to pursue the pending civil suits and if necessary, by filing fresh applications therein.

Accordingly, the Writ Petition is dismissed as withdrawn, with liberty to the

petitioners in terms of the prayer made.

As a sequel to dismissal of the writ petition, W.P.M.P.No.3622 of 2016 filed by the petitioners for interim relief shall stand dismissed as infructuous. ______________________________ C.V.NAGARJUNA REDDY, J 01st February, 2016 GHN
