THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.27871 OF 2017 ORDER:

This writ petition is filed challenging the order of suspension passed on 20.07.2017 by the fourth respondent and calling for proposals for appointment of in-charge dealer.

When this writ petition was listed for admission, the learned Government Pleader was directed to obtain instructions whether any consequential action was taken pursuant to the suspension of authorization of the petitioner. Now the learned Government Pleader produced before this Court a copy of the show cause notice dated 26.08.2017 asking the petitioner to submit his explanation for two charges framed therein. As rightly pointed out by the learned counsel for the petitioner, the said show cause notice was issued only after filing the writ petition on 18.08.2017. This type of procrastination and harassing the petitioner by the fourth respondent is not appreciated by this Court. When the fourth respondent thought it fit to suspend the authorization, he should immediately issue a show cause notice pointing out the irregularities in respect of which he wanted to take action.

Be that as it may, in view of the pendency of the proceedings before the fourth respondent, the fourth respondent is directed to complete the enquiry as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order, after giving due opportunity to the petitioner.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 01.09.2017 pln
