This writ petition is filed aggrieved by the inaction of Tahsildar, Bobbili, on the representation made by the petitioners on 20.01.2016, requesting for change of classification of lands covered by Sy.No.1/3, of Kasidoravalasa village, from assessed waste dry land to Jerayti. Alleging wrong classification of land as the waste dry land and such classification was made without any notice or giving opportunity to the petitioners, this writ petition is filed.

When the matter is taken up, learned Government pleader points out that Tahsildar is not competent to change the classification of land. Therefore, petitioners ought to have made representation to the District Collector, Vizianagaram. 4.

At this stage, learned counsel for the petitioners, seeks leave of the Court to make representation to the District Collector, Vizianagaram, ventilating the same grievance as agitated before the Tahsildar.

Leave as sought for, is granted. If the petitioners make representation to the District Collector, Vizianagaram, ventilating their grievance as agitated in their representation dated 20.01.2016, the District Collector shall examine the claim in accordance with law and as per the Revenue records, and take appropriate course of action as warranted by law. He shall take decision and assign due reasons in support of his decision and

- 3 - communicate the same to the petitioners. Such a decision shall be taken and communicated to the petitioners, within a period of two

(2) months from the date of receipt of such representation, if any made.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
