THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24652 of 2005 ORDER:

This writ petition is filed seeking the following relief: " This Hon'ble court may be pleased to issue any appropriate writ , order or order or direction more particularly one in the nature of writ of Mandamus:

1. To declare the petitioner as senior to Smt.Veenadhari and Smt.Nirupa

2. To restore the seniority of the petitioner with effect from 16.9.1991, the date of promotion of his juniors as Assistants (Junior Personal Officer)

3. To grant all benefits flow out of prayer 2." Heard Sri S.Ravinderanath, learned counsel for the petitioner and Smt. K.Udaya Sri , learned standing counsel for the respondentCorporation. It has been contended by the learned counsel for the petitioner that juniors to the petitioner have been promoted ahead of him ignoring the case of the petitioner and that the petitioner is entitled for promotion on par with his juniors. During the course of hearing, it is noticed that the petitioner retired from service. If the petitioner has any grievance, he is at liberty to submit a representation to the respondent-Corporation and on submission of such representation, the respondentcorporation shall consider the representation and pass appropriate in accordance with law. If the petitioner is declared as eligible for

promotion on par with his juniors, his case shall be considered for notional promotion and notional benefits.

With these observations, the Writ Petition is disposed of. No costs.
