THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.7826 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Irrigation & CAD.

When the matter is taken up a letter, bearing Lr.No.DB/TO/WP No.7826 of 2018/22/M, dated 14.03.2018, addressed by the Superintending Engineer, WRD, Irrigation Circle, Chittoor to the office of the learned Government Pleader, is placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance in the present Writ Petition, read as under:

" Tenders were invited on 'e' procurement platform vide this office Tender notice No.52/2017-18, dated 30.08.2017 duly fixing dates for availability of tender documents in online as follows:

Schedules available in online : from 04.09.2017 at 11.00 am. onwards to 11.09.2017 upto 5.30 p.m.

2.

Last date of receipt of tenders in online:

11.09.2017 upto 5.30 p.m.

3.

Date of opening of price bid in online:

12.09.2017 at 11.00 a.m.

The technical bid for the above work was opened online on 12.09.2017. The price bid for the above work was opened on 10.10.2017. The tenderer M/s NPR Company has quoted his tender percentage at (+) 4.41% Excess over the ECV of Rs.17,76,784/-. The contract value of tenderer works out to Rs.18,55,140/-. The Agreement was concluded with the lowest quoted

bidder M/s NPR Company vide Agreement No.693 SE/2017-18, Dt: 29.11.2017 and the work is in progress".

Having regard to the above instructions and the particulars furnished therein, no relief, in favour of the petitioner herein, can be granted.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
