HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No.1004 of 2012 JUDGMENT :

This appeal is preferred against order dated 24.08.2012 in I.A.No.517 of 2012 in O.S.No.486 of 2012 on the file of II-Additional Senior Civil Judge, City Civil Court, Hyderabad, whereunder the Court below granted temporary injunction on merits.

Aggrieved by the injunction order, defendants preferred the present appeal.

2. As seen from the office note, the main suit O.S.No.486 of 202 was disposed of on 02.11.2012. Though this case is listed under the caption 'specially identified cases', neither advocate for appellants is present nor any representation made. The appeal is of the year 2012 and it is till at the stage of service of notice.

3. Considering these aspects, appeal is dismissed for non-prosecution.

4. Miscellaneous petitions pending, if any, shall stand closed. No costs.
