JUDGMENT

When the matter is taken up for hearing, there is no representation for the appellant.

It is represented that learned counsel for the appellant is no more and therefore notice was ordered to the appellant directing him to appear before the Court on 29.04.2022, but he did not appear before the Court. On 12.10.2022 also, there is no representation by the appellant. Therefore, the matter was directed to be listed today under the caption 'for dismissal'. Today also, there is no representation for the appellant. Therefore, this Court is of the considered view that the appellant is not interested to pursue the litigation.

Hence, the Appeal is dismissed for nonprosecution. No costs.

Pending miscellaneous applications, if any, shall stand closed.
