.. Respondents Counsel for the Petitioner: Mr. M.S.P.Kamaraju Counsel for the Respondents : A.G.P. for Home (A.P) THE COURT MADE THE FOLLOWING:

CVNR, J & AVSS,J W.P.No.38996_16 ORDER: (Per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for issue of Habeas Corpus to produce one Subramani Karthikeyan (hereinafter referred to as 'the detenu'), the brother-in-law of the petitioner, who was allegedly taken into illegal custody by respondent Nos.3 to 5, before the Court. At the hearing, the learned Assistant Government Pleader for Home (A.P), on instructions, submitted that the alleged detenu is arrested and produced before the jurisdictional Magistrate in Kadapa in connection with Crime No.234 of 2016 of C.K.Dinne Police Station and that he is remanded to judicial custody.

Mr. M.S.P.Kamaraju, learned counsel for the petitioner, submitted that his client does not have any information about the alleged arrest and judicial remand of the detenu.

Having regard to the above-mentioned statement of the learned Assistant Government Pleader, we have no reason to disbelieve the same. Inasmuch as the alleged detenu is stated to have been remanded to judicial custody on being arrested and produced in connection with the aforementioned case, the cause in this writ petition does not survive for adjudication.

The writ petition is, accordingly, closed with liberty to the petitioner to avail appropriate legal remedy for securing the release of the alleged detenu.
