The petitioner-The Legend Inder Residency Flat Owners Welfare Association challenges the action of respondents 2 and 3 in not taking action against the 4th respondent, who is allegedly making illegal constructions by deviating from the sanctioned plan.

The averments in the writ affidavit are to the effect that the petitioner is an association of flat owners of the building constructed in the premises No.3-6-69/B/8, Avanthinagar, Basheerbagh, Hyderabad. The petitioner made a complaint to the respondent authorities against the 4th respondent on 24.10.2018 and on 26.10.2018 stating that the 4th respondent has permission to construct only upto four floors, but he is proceeding with construction of 5th floor. The grievance of the petitioner is that respondents 2 and 3 are not acting on the complaint and not stopping the illegal construction.

Heard learned counsel for the petitioner, and the learned Government Pleader for Municipal Administration and Urban Development (Telangana). The grievance of the petitioner being non-consideration of the complaints dated 24.10.2018 and 26.10.2018 made by the petitionerAssociation, the writ petition is disposed of with a direction to the 2nd respondent to consider the complaints dated 24.10.2018 and 26.10.2018 and take action in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any pending, shall stand closed.
