Heard before admission and before notice to the respondentsplaintiffs. Undisputedly, the matter is at the stage of arguments. It is not a case of re-casting of issues and letting of evidence pursuant thereto. Thereby at this stage, the so called re-casting of issues sought for not considered by the lower Court is for effective decision of the matter for evidence on record.

Once such is the case, the Court also from the evidence on record formulate at least the points for consideration in connection with the issues on record or even the suo-moto and also by virtue of this order wherever necessary in the course of hearing arguments re-caste the issues for decision and to that extent only but not necessary of adducing any further evidence.
