THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10134 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.3 seeking grant of anticipatory bail in crime No.136 of 2015 on the file of Jawahar Nagar Police Station, Cyberabad, registered for the offence under Section 380 IPC.

Heard and perused the material available on record. The case of the prosecution is that originally the case is registered against some other persons for an offence under Sections 457 and 380 IPC. Later, the petitioner is arrayed as A.3 for the offence under Sections 457, 480 IPC read with 411 IPC. The accused are alleged to have committed theft of gold ornaments, some cash and US dollars also.

Learned counsel for the petitioner submits that the petitioner is later arrayed as A.3 and further, he has not committed any offence and he has been falsely implicated in the case. Hence, he prays this Court to grant anticipatory bail to the petitioner herein.

Considering the fact that the petitioner is also having previous cases, this Court is not inclined to grant anticipatory bail to the petitioner herein. The criminal petition is accordingly dismissed. _____________________ JUSTICE RAJA ELANGO 08.10.2015 pln
