Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue. With the consent of both parties, the writ petition is heard at the admission stage itself. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the respondents in enrolling the names of the petitioners in voters list of the village of Jorepalli, Rapur Mandal, SPSR Nellore District as arbitrary and illegal and consequently to direct the respondents to enrol the names of the petitioners in the voters list of the village of Jorepalli, Rapur Mandal.

The factual matrix leading to filing the present writ petition is that all the petitioners are permanent residents of Jorepalli village, Rapur Mandal, SPSR Nellore District and are having residential houses as well as ration cards in the village of Jorepalli. It is stated that their names were enrolled in the

Electoral list of the village and their village is in the Assembly Constituency of Venkatagiri. While the things stood thus, the 1st respondent deleted the names of the petitioners from the electoral list of the village on the basis of a report given by the 3rd respondent without giving any opportunity to them, though the petitioners are having Ration Cards. It is further stated that the petitioners made a representation on 01-12-2011 to the 1st respondent requesting him to enrol their names in the electoral list of their village. The 1st respondent, having acknowledged the receipt of the representation, neither took any action nor passed any orders thereon. Challenging the said inaction, the present writ petition came to be filed.

Having regard to the facts and circumstances of the case and without going into the merits of the case, the writ petition is disposed of directing the 1st respondent to consider the request of the petitioners for enrolling their names as voters in the electoral list of Jorepalli village, if they are found to be eligible and if the process of the enrolment is in force. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
