ORDER: (per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) Both the learned counsel for the parties are ad idem that the issue involved in the present writ petition is squarely covered by the judgment pronounced by a learned Coordinate Bench of this Court in W.P.No.3386 of 2017 and bunch matters, in Bharath Sanchar Nigam Limited and others v. Ch.Brahmam and others. The issue before the learned Court in the said writ petitions was whether the pay of an admitted senior could be pegged up to the pay drawn by the admitted junior in the same cadre, applying Sub-Rule (23) of Fundamental Rule 22, as quoted by the Division Bench of the Kerala High Court in the judgment in OP (CAT) No.1576 of 2012 (Z), or not ? By the said judgment, this Court has dismissed the writ petitions filed by the petitioners therein.
Therefore, the present writ petition is equally dismissed on the same ground as the judgment mentioned hereinabove. There shall be no order as to costs.
As a sequel, miscellaneous petitions, pending if any, stand closed.
