HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.4623 of 2015 ORDER:

Heard.

The petitioner states that it is carrying on business of Black Jaggery and Alum in the name and style of M/s.Someshwara Traders at the premises bearing H.No.3-107/B situated at Gidiwada Chowrastha, Palakurthy, Warangal District. The petitioner states that it has requisite licence and it has been purchasing Black Jaggery and Alum from various customers and selling the same under valid bills. Alleging that respondents 2 to 4 are frequently visiting its shop and threatening it to close down the business, the petitioner filed the present writ petition.

Learned Government Pleader has received instructions from respondents 2 to 4, wherein while denying the allegations made by the petitioner, it is stated that respondents 2 to 4 never interfered with the lawful business activity of the petitioner nor asked it to close down the business. It is further stated that no complaint whatsoever is received against the petitioner. It is also stated that as and when any information is received with regard to conducting of unlawful business by the petitioner, appropriate action will be taken by following due procedure.

In view of the above instructions, it is clear that this writ petition is filed only to seek anticipatory relief, in the event of taking any action by respondents 2 to 4. The allegations of the petitioner are totally unsubstantiated. As the respondents stated that they never interfered with the lawful business of the petitioner, there is no reason to entertain the writ petition and it is accordingly dismissed. The respondents, however, are at liberty to take appropriate action against the petitioner, in accordance with law, as and when any violation is found in future. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
