ORDER

This writ petition is filed challenging the action of respondents 3 and 4 in awarding the works contract for construction of balance items of ZPHS building at Jogipet Village, Andole Mandal and Assembly Constituency in Medak District, to the 5th respondent.

The 3rd respondent-Superintending Engineer filed a counter-affidavit stating that after following due process of law, the tender was awarded to the 5th respondent. The 5th respondent became the lowest tenderer @ 7.20% less than the sanctioned estimates and the same was accepted by the Engineer-in-Chief on 3.12.2016. Letter of acceptance was issued on 8.12.2016. The agreement was entered on 11.01.2017 and the period of completion is nine months i.e., 10.10.2017. It is also stated that suo motu case was taken up by the Lokayukta for AP & Telangana and reports were called for and that the Deputy Registrar of Lokayukta is periodically reviewing the physical stage of work and action taken report is being updated to him regularly and now the work is nearing completion.

As per the original agreement, the work is required to be completed by today. In view of the same, nothing survives for consideration in the present writ petition.

Accordingly, the Writ Petition is dismissed as infructuous. No costs.
