Ch.Yadagiri v. The Honble Labour Court - I, Hyd, And 3 Others
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.4141 OF 2008
ORDER
When the matter is taken up for hearing, learned counsel appearing for the petitioner submits that challenging the removal order passed by the respondent-Corporation, the petitioner had preferred I.D.No.155 of 2004 before the Labour Court, Hyderabad, which, in turn, dismissed the same on 25-04-2007; that in the meanwhile, the petitioner had retired from service on attaining the age of superannuation and hence, the question of reinstating the petitioner into service does not arise. Learned counsel further submits that the service benefits of the petitioner may be released to him for the service rendered by him from the date of his initial appointment till the date of his removal.
Learned Standing Counsel appearing for the respondent-Corporation does not dispute the same. In view of the same, this Writ Petition is disposed of directing the respondent-Corporation to release the service benefits to the petitioner for the service rendered by him from the date of his initial appointment till the date of removal, if not already paid, in accordance with the Service Regulations
of the Corporation, within a period of four weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any, pending shall stand closed.
