HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.13178 of 2015 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Excise.

The petitioners complain that in spite of making payment to the 6th respondent, the stocks are not being supplied to them. Learned Government Pleader submits that the stocks were already supplied to the petitioners.

Similar grievance was considered by this Court in W.P.No.6594 of 2015, dated 25-03-2015, wherein this Court held that if stocks are already supplied to the petitioners therein, the direction therein will not apply to such of the petitioners and will only apply to the petitioners therein, who were not supplied stocks in spite of making payments. In view of the same, this writ petition is disposed of in terms of W.P.No.6594 of 2015, dated 25-03-2015, directing respondents 1 to 4 to supply stocks to such of the petitioners, who have already made payments by way of challans, which are already credited and accepted by the Government. It is made clear that if any of the petitioners are already supplied the stocks against the said payment, the direction herein will not apply to such of the petitioners and this direction will be applicable only to such of the petitioners, who were not supplied stocks in spite of making payments. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
