THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2446 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/Accused No.3 in the event of his arrest in connection with Crime No.427 of 2020 on the file of Station House Officer, Shankerpalli Police Station, Cyberabad registered for the offence punishable under Section 326 read with Section 34 of Indian Penal Code, 1860 (I.P.C.) 2.

Heard the learned counsel for the petitioner, learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

Learned counsel for the petitioner submits that, this is a case and counter case that the Accused No.2 gave a complaint which is registered in Crime No.426 of 2020 for the offences under Section 324 read with Section 34 of IPC and Section 3(1)(r)(s) of the SCs & STs (POA) Act on 25.10.2020 and as the counter blast to the said case, the present case is registered under Section 326 read with Section 34 of IPC . He further submits that the petitioner is a

student and if he is arrested his career will be ruined. He further submits that this Hon'ble Court granted anticipatory bail to the Accused Nos.1, 2 and 4 on 06.12.2021 vide Criminal Petition No.8820 of 2021.

Learned Assistant Public Prosecutor submits that it is a case of the year 2020 and it is a case and counter case and charge sheet is filed.

The allegations against the petitioner/Accused No.3 and Accused Nos.1, 2 and 4 are one and the same. In the said circumstances, the benefit of bail can be extended to the petitioner/Accused No.3.

Accordingly, the Criminal Petition is allowed subject to the following conditions:

i) The petitioner/Accused No.3 is directed to surrender before the Station House Officer, Shankerpalli Police Station, Cyberabad, within a period of one week from today, and on such surrender, the said Station House Officer shall release the petitioner/Accused No.3 on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties for a like sum

each to his satisfaction. Further, it is made clear that no further extension of time will be granted.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
