Heard learned counsel for petitioner and learned Government Pleader for respondents.

Challenging the action of the respondents 2 and 3 in seizing 60 bags of rice worth Rs.39,000/- under Panchanama dated 10.07.2017. Thereafter, proceedings under Section 6-A of the Essential Commodities Act (the Act, for brevity) were initiated and they are pending before the second respondent.

Since proceedings under Section 6-A of the Act are pending, this Court is not inclined to interfere with the same. However, the petitioner is willing to furnish Bank Guarantee for the value of the rice seized under Panchanama dated 10.07.2017 and in view of the same, the seized stocks shall be released to the petitioner on condition of the petitioner furnishing Bank Guarantee for the entire value of the stocks seized, subject to satisfaction of the second respondent. As and when the petitioner furnishes Bank Guarantee, the seized stocks shall be released to the petitioner and the Bank Guarantee shall be subject to further orders to be passed in proceedings under Section 6-A of the Act.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 01.08.2017 pln
