HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.2540 OF 2017 ORDER:

The present Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.), requesting to quash the proceedings in C.C. No.7 of 2015 on the file of III Additional Chief Metropolitan Magistrate, Erramanjil, Hyderabad, arising out of Crime No.78 of 2014 of Karkhana Police Station, Secunderabad, Hyderabad District.

2. The petitioner viz., M.A. Arif, who is arraigned as accused No.3, alleged to have committed the offences punishable under Sections 188, 171-E and 171-B of Indian Penal Code, 1860 (IPC).

3. Sri P. Sriharinath, learned counsel for the petitioner, would draw attention to the orders passed by this Court so far as accused Nos.2 and 1 are concerned, in Criminal Petition Nos.10986 and 13939 of 2016, dated 27.07.2016 and 30.09.2016, respectively, whereby and whereunder, the very same proceedings were quashed against them.

4. Since the petitioner herein is accused No.3 and his case also stands on the same footing as that of accused Nos.1 and 2, certainly, he cannot be discriminated from accused Nos.1 and 2.

5. Therefore, the Criminal Petition is allowed quashing the proceedings in C.C. No.7 of 2015 on the file of III Additional Chief Metropolitan Magistrate, Erramanjil, Hyderabad, against the petitioner herein.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
