THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35869 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in interfering in civil disputes between the petitioner and the fourth respondent as illegal and arbitrary, and consequently to direct the third official respondent not to interfere in the civil disputes between the petitioner and the fourth respondent.

Heard and perused the material.

Learned counsel for the petitioner submits that the third respondent is interfering in the civil dispute between the petitioner and the fourth respondent, and he is threatening the petitioner to dispossess from premises No.19-1-9134/1/1, Devi Bagh, Patel-ki-Bowli, Hyderabad, and as such, he prays this Court to direct the third respondent not to dispossess the petitioner forcibly from the subject premises at the instance of the fourth respondent. Learned Assistant Government Pleader for Home (Telangana) submits that the third respondent is not interfering with the affairs of the petitioner and he is not trying to dispossess the petitioner from the subject premises.

Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the third respondent not to interfere in the civil disputes between the petitioner and the fourth respondent and not to dispossess the petitioner from the subject premises. The third respondent is further directed to follow the due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 24.10.2016 pln
