Vedula Venkataramana, learned senior counsel, representing M/ s. Bharadwaj Associates, learned counsel for the petitioner, states that the matter has become infructuous as the auction proposed to be held by the second respondent - State Bank of India failed. He seeks leave to permit the petitioner to file a fresh case as and when a new cause of action arises.
Recording the said statement, the writ petition is dismissed as infructuous with the liberty aforestated. Pending miscellaneous petitions shall also stand dismissed. There shall be no order as to costs.
