THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.16869 OF 2016 ORDER:

This criminal petition is filed under Section 482 of Cr.P.C to quash the proceedings in Crime No.59 of 2014 on the file of Khammam II Town Police Station, Khammam District. The defacto complainant filed a private complaint under Sections 120(A), 120(B), 506, 406, 409, 420, 464, 465 & 468 IPC. The I Additional Judicial Magistrate of First Class at Khammam, by exercising power under Section 156(3) Cr.P.C referred the matter to the police for investigation and on receipt of the same, crime was registered and F.I.R No.59 of 2014 was issued on the file by Khammam II Town Police Station, Khammam District on 15.02.2014. It appears, the police did not complete the investigation and further, no extension was obtained from the Court.

Delay in investigation leads to serious consequences and in the absence of any reason for the delay, keeping the matter pending for investigation for years together would violate the fundamental rights guaranteed under the Constitution. Therefore, I deem it appropriate to issue a direction to the Station House Officer, Khammam II Town Police Station, Khammam District to complete the investigation, as expeditiously as possible, preferably within a period of three months from the date of receipt of the copy of the order and file final report.

MSM,J CrlP_16869_2016 With the above direction, the criminal petition is disposed of. Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
