Vaishnavi Desharapu, v. State Of Telangana,
HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.9643 OF 2019 ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking the following relief: "For the reasons stated in the affidavit filed in support of the above Writ Petition it is hereby prayed that this Hon'ble Court may be pleased to direct the 2nd Respondent to authorize and recognize the participation of athletes in the "National Multiclass Regatta" sailing competition being conducted by the 3rd Respondent, 4th Respondent and 5th Respondent, pending disposal of this writ petition pending disposal of the above writ petition and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case." 2.
Heard Sri N.Jeevan Kumar, learned counsel appearing for the petitioners and the learned Government Pleader for Sports Department appearing for the 1st respondent.
3.
The case of the petitioners is that they are all athletes, who are trained and truly participating in the sailing sport. 4.
The grievance of the petitioners is that the "National Multiclass Regatta" sailing competition is notified to be conducted by respondents 3 to 5 from 02.05.2019 to 07.05.2019 at different levels and the petitioners are apprehending that if their sport is not recognised or authorized or supported by the 2nd respondent, their entire exercise and their career would be at stake and will miss an opportunity in participating in "National Multiclass Regatta" event for the present year.
5.
Without going into the merits of the case, this Court feels that it would be just and proper to direct the respondents to consider the case of the petitioners.
TA, J W.P.No.9643 of 2019 6.
Accordingly, the Writ Petition is disposed of directing the 2nd respondent to consider the representation of the petitioners, dated 20.10.2019, and pass appropriate orders, in accordance with law, on or before 01.05.2019. There shall be no order as to costs. Miscellaneous Petitions, if any pending, shall stand closed. _________________________ T.AMARNATH GOUD, J Date: 29th April, 2019 Note: Issue C.C. today.
