THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.2447 OF 2022 ORDER:
This petition is filed under Section 438 Cr.P.C. seeking bail to petitioner/A1 in the event of his arrest in connection with Crime No.917 of 2021 on the file of Malkajgiri Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 420, 471, 120(b) read with Section 34, 465, 467 and 468 of the Indian Penal Code.

Heard the learned counsel for the petitioner, and learned Assistant Public Prosecutor for the respondent-State.

Other than Section 467 of IPC, the punishment prescribed for the other offences alleged against petitioner/A1 is up to seven years. There are no averments in the complaint to attract an offence under Section 467 of IPC, which fact is not disputed by the learned Assistant Public Prosecutor.

In the said circumstances, I deem it appropriate to direct the respondent-Police to follow the procedure as contemplated under Section 41-A Cr.P.C and the guidelines formulated by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1 scrupulously. It is needless to say, any deviation in this regard will be viewed seriously.

The Criminal Petition is accordingly, disposed of.

Miscellaneous applications pending, if any, in this criminal petition, shall stand closed.
