THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.9636 of 2012 ORDER:
Tenders were invited for house keeping for the period 2012-2014. The petitioner was the erstwhile contractor for the period 2008-2010. In the order in W.P.M.P.No.12188 of 2012 dated 27.07.2012, the Learned Judge has recorded that the petitioner's performance was not satisfactory; and though notices were issued asking him to improve his performance, he had failed to respond thereto and had, instead, filed the writ petition. The Learned Judge also noted that the petitioner's technical bid was not found eligible under Clause 13(f) of Section IV of the tender document; and as he was not technically eligible, the work was already awarded to the 3rd respondent. The WPMP was dismissed.
As a result, the 3rd respondent must have already executed the work for the period 2012-2014. Since more than four years have elapsed, since the expiry of the period of the tender, it is evident that the cause in the writ petition does not survive necessitating any further adjudication by this Court.
The Writ Petition is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
