THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37887 of 2015 ORDER:
The grievance of the petitioner is that the police authorities failed to conclude the investigation and file a final report in relation to Crime No.203 of 2014 on the file of I Town Police Station, Nellore. Written instructions dated 28.12.2015 were furnished by the Inspector of Police, Nellore I Town Police Station, SPSR Nellore District, to the office of the learned Government Pleader for Home stating that Crime No.203 of 2014 had been registered under Sections 418, 420, 427, 466, 468 & 341 I.P.C. read with Section 34 I.P.C., upon forwarding of the complaint made by the petitioner before the learned II Additional Judicial Magistrate of First Class, Nellore, under Section 156(3) Cr.P.C.
Upon investigation, the police authorities however found that the essential ingredients to establish an offence under the mentioned sections were not made out and accordingly filed a final report before the learned II Additional Judicial Magistrate of First Class, Nellore, on 15.12.2015. Notice to this effect was also stated to have been given to the complainant, the petitioner herein. Copies of the final report along with the notice given to the petitioner are produced before this Court.
In the light of the aforestated developments, the grievance of the petitioner as to the alleged inaction on the part of the police authorities in relation Crime No.203 of 2014 on the file of I Town Police Station, Nellore, stands settled. If the petitioner is aggrieved by the final conclusion arrived at by the police authorities, it is for him to avail appropriate legal remedies in accordance with law. Reserving liberty to the petitioner to do so, the writ petition is closed.
Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
