HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18311 of 2016 ORDER:
This writ petition came to be filed challenging the demand notices dated 02.06.2015 issued by the 2nd respondent - Khammam Municipal Corporation, demanding property tax from the 2nd petitioner - Society as illegal, arbitrary and against the principles of natural justice and consequently sought a direction to the respondents to exempt the petitioners from payment of property tax.
Heard learned counsel for the petitioners as well as the learned Government Pleader for Municipal Administration and Urban Development Department, and also Smt. M. Bhagyasree, learned Standing Counsel for the 2nd respondent - Corporation.
Though learned counsel for the petitioners raised various grounds in the writ petition, he mainly contended that the petitioners Society, being a Charitable Institution, cannot be subjected to payment of property tax. Hence, it is urged that appropriate directions may be issued to the authorities concerned to consider the representation dated 06.04.2016 submitted by the petitioners in accordance with law.
On the other hand, Ms. M. Bhagyasree, learned
Standing Counsel for the 2nd respondent - Corporation, submits that if the representation dated 06.04.2016 submitted by the petitioners is still pending, the same will be dealt with in accordance with law.
In view of the above facts and circumstances and without going into the merits of the case, this writ petition is disposed of directing the 2nd respondent - Corporation to consider the representation dated 06.04.2016 submitted by the petitioners and pass appropriate orders in accordance with law, as early as possible, after giving an opportunity of hearing to the petitioners, if the same is still pending consideration. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
