Petitioner claims that he was appointed as Conductor in the year 1982. He was earlier terminated in the year 1996 but on appeal he was reinstated into service with continuity of service in the year 1996. The grievance of the petitioner is that after reinstatement, in the pay revisions of the years 2003, 2007 and 2011 appropriate pay fixation benefit was not extended to him causing huge financial loss. The petitioner retired from service on attaining the age of superannuation on 31.7.2013. Claiming to fix his pay benefits as per his entitlement, the petitioner claims to have submitted a representation to the Regional Manager, Hyderabad Region- second respondent on 7.5.2016. Alleging inaction in considering the representation and extending pay fixation benefits, this Writ Petition is filed. 2.

Since the petitioner claims that a representation was made for consideration of entitlement of appropriate pay fixation and the same is yet to be disposed of, without expressing any opinion on merits, this Writ Petition is disposed of directing the Regional Manager, Hyderabad Region - second respondent to consider and pass orders on the representation said to have been submitted by the petitioner on 5.7.2016.

Learned Standing Counsel expressed apprehension about the submission of such representation as no acknowledgement is filed. 4.

Having regard to this objection, counsel for the petitioner submits that the petitioner will submit fresh representation enclosing a copy of the representation dated 5.7.2016 within ten days from the date of receipt of a copy of this order. As and when such representation is submitted enclosing a copy of the earlier representation dated 5.7.2016, second respondent shall consider the same and pass orders within eight weeks thereafter. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
