Heard Sri Pulla Rao Yellanki, learned counsel for the petitioner who has filed the present Transfer Criminal Petition requesting to withdraw D.V.C.No.18 of 2016 on the file of the III Metropolitan Magistrate, Hyderabad and to transfer the same to the file of the Judicial First Class Magistrate at Khammam by exercise of power under Section 407 of the Code of Criminal Procedure.

Though notice was ordered and process was taken by way of personal notice and despite service of notice on the 2nd respondent, who is also the respondent in D.V.C., he did not enter appearance. 3.
Perused the affidavit filed herein and the reasons assigned by the petitioner and since it is stated in the affidavit that the petitioner moved to Khammam for her children's education and their welfare, as she can afford the expenditure at Khammam, which would be cheaper compared to Hyderabad and since there is no opposition in view of the respondent not entering appearance to resist the request, the request is acceded to withdrawing D.V.C. No.18 of 2016 from the file of the III Metropolitan Magistrate, Hyderabad and transferring the same to the Judicial First Class Magistrate at Khammam.

Transfer Criminal Petition is accordingly allowed.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Transfer Criminal Petition stand closed.
