14.12.2022 HCJ & CVBRJ On 24.11.2022 we had passed an order in Transferred to i/o folder, before corrections, if any.

W.P.No.27671 of 2007 to list the same along with W.P.No.26553 of 2005 under the caption "covered matter" on 30.11.2022.

Registry had made an endorsement that W.P.No.26553 of 2005 was disposed of on 09.06.2006. We find that W.P.No.26553 of 2005 was dismissed by this Court on 09.06.2006. Thereafter the matter was taken in appeal to the Supreme Court, being Civil Appeal No.1114 of 2007 (M/s. Shriram Chits (P) Limited v. Central Board of Direct Taxes). By the order dated 27.02.2007 the order of this Court dated 09.06.2006 was set aside and the matter was remanded back to the High Court for a decision on merit.

It is submitted that on such remand, the matter was heard and reserved for judgment on 03.07.2007. However, judgment was not pronounced. Thereafter, the matter was listed on a couple of occasions, the last date

being on 16.11.2009.

In the above circumstances, we are of the view that both the writ petitions are required to be heard. List the two writ petitions for hearing on 28.12.2022.
