THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12979 OF 2016 ORDER:
This petition is filed by the petitioners-A2, A3, A5 to A8 under Section 482 Cr.P.C. seeking to quash the proceedings against them in FIR No.173 of 2016 on the file of Madnoor Police Station, Nizamabad District, registered for the offence punishable under Sections 448, 498-A, 494, 324, and 509 r/w 34 IPC.
Heard and perused the material available on record. A1 is the husband of the 2nd respondent. A2 and A3 are the parents, and A5 and A6 are brother and sister of A1. A7 and A8 are the sister and brother-in-law of A1.
Learned Counsel for the petitioners submitted that the petitioners were falsely implicated in the above crime and they are no way concerned with the allegations made in the complaint and that the 2nd respondent left the matrimonial home on her own.
Learned Additional Public Prosecutor opposed this petition. The truth or otherwise of the allegations cannot be decided by this Court. Considering the facts and circumstances of the case and the nature of the allegations made against the petitioners, this Court is not inclined to grant the relief sought by them. However, the 1st respondent-police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioners. In the event of necessity, the 1st respondent-police are directed to issue notice to the petitioners to appear before the investigating agency for the purpose of investigation. On issuance of such notice, the petitioners are directed to appear before the investigating agency and give an undertaking as to their future appearance as and when required for the purpose of investigation.
Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 2.9.2016 Nn
