THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38963 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of 2nd respondent in not taking legal action as per the petitioner's complaint dated 18.09.2016 against respondents 3 to 6 and their associates, as illegal and arbitrary.

The main grievance of petitioner is that the 2nd respondentStation House Officer, CCC Naspur Police Station, Mancherial District, is not registering a case against respondents 3 to 6 basing on the complaint lodged by him on 18.09.2016. 3.

Considering the facts and circumstances of the case and in view of the grievance of petitioner, the 2nd respondent is directed to register a case against respondents 3 to 6 if the complaint lodged by the petitioner dated 18.09.2016 discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of 2nd respondent, he is at liberty to approach the superior officer of 2nd respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.
