THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Contempt Case No. 1208 of 2016 Order:

This Contempt Case is filed alleging non-implementation of the order dated 21.09.2015 passed in W.P.No.30771 of 2015. In the said Writ Petition this Court passed an order on 21.09.2015 directing the second respondent, the Commissioner, Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS), Hyderabad, to dispose of the appeal filed by the petitioner on 03.08.2015 in accordance with law after affording an opportunity of hearing to her within a period of eight weeks from the date of filing of the appeal. This Court issued notice on the Contempt Case on 15.07.2016 and there was no response from the respondent. When it was listed again on 16.09.

2016 learned counsel appearing for the Contemnor took time for filing a counter and even today also he did not file a counter, but he produced before this Court a copy of the order alleged to have been passed on 03.03.2016. This type of practice by the Contemnors or their counsel is highly deprecated. Since the petitioner is absent, this Court is inclined to close the Contempt Case in view of disposal of the appeal on 03.03.2016 though belatedly.

The Contempt Case is, accordingly, closed. There shall be no order as to costs. The miscellaneous applications pending, if any, shall stand closed.
