HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 8971 OF 2007 O R D E R:
This Writ Petition was field challenging the notification dated 18.3.2006 issued under Section 4(1) of the Land Acquisition Act, (for short "the Act") with regard to agricultural lands of the petitioners to an extent of Ac. 0.86 cents, Ac. 0.37 cents, Ac. 0.39 cents, Ac. 0.82 cents, Ac. 0.40 cents, Ac. 0.42 cents, Ac. 0.48 cents, Ac. 0.55 cents in S.Nos. 61/4, 211/1, 211/2, 211/4, 211/5, 211/6, 212/8, & 212/9, situated at Arur Village, Sathyavedu Mandal, Chittoor District. Even as per the learned counsel appearing for petitioners Section 6A declaration was published on 10.11.2006 but the same was not challenged. However, they filed the present Writ Petition and this Court granted interim stay on 26.4.2007. Seeking vacation of the same, WVMP No. 3427 of 2014 was field stating that at the instance of APIIC, Tirupati, an extent of Ac. 58.

under Section 4(1) of the Act was submitted to the District Collector, Chittoor on 13.3.2006 and the District Collector approved the said proposals and the same were published in the locality on 24.4.2006 after publishing the same in the Gazette in the year 2006 and an award was passed on 18.3.2007. The second petitioner did not attend the award enquiry and the first petitioner is none other than the father of the second petitioner. Suppressing all these facts, the petitioners filed the Writ Petition.
In view of passing of the award as aforesaid, nothing survives for consideration in the Writ Petition and the Writ Petition is accordingly dismissed. However, it is open to the petitioner to take appropriate proceedings in accordance with law. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
