HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.1667 of 2017 Order:

This Writ Petition was filed challenging the action of the respondents, more particularly the third respondent in sending the police to the house of the petitioner and calling him over phone on 07.01.2017 and harassing him by threatening to detain him in the police station. Learned Government Pleader for Home, on the basis of written instructions, submits that the son and daughter of the petitioner lodged a complaint on 05.01.2017 with the third respondent and basing on the same an entry was made in the General Diary on 05.01.2017. After conducting preliminary enquiry Crime No.36 of 2017 was registered on 28.01.2017 under Sections 342, 452, 323, 506 read with 34 IPC against the petitioner and one Parvathi and investigation was taken up. During the course of investigation the complainant and another witness were examined and their statements were recorded. The investigation is under progress.

In view of the same, this Court cannot interfere with the investigation process, but the police while conducting investigation should adhere to the rule of law.

With the above observation, the Writ Petition is closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
